ONBASE TERMS OF SERVICE

1. PLATFORM OWNER

The Platform OnBase is owned and operated by OnBase, a sole proprietorship business operated by Mihir Gopani, based in Ahmedabad, Gujarat, India.

For the purpose of these Terms:

• “OnBase”, “we”, “us”, or “our” refers to the platform operator.
• “User” or “Customer” refers to any person or business using the Platform.
• “Workers” or “Professionals” refers to independent construction professionals who offer services through the Platform.

These Terms form a legally binding agreement between OnBase and all users of the Platform.

2. DESCRIPTION OF SERVICES

OnBase provides a technology platform that enables Users to connect with independent construction Workers and Professionals for various on-site construction tasks.

Through the Platform, Users may:

• browse available Professionals
• schedule Workers for construction tasks
• manage service bookings
• process payments through supported payment methods

Workers and Professionals may offer services such as:

• brick masonry
• tile installation
• RCC slab assistance
• general construction assistance
• other civil construction tasks

These services are referred to as “Professional Services.”

3. ROLE OF ONBASE

OnBase acts solely as a technology intermediary and marketplace platform.

OnBase does not:

• provide construction services directly
• employ Workers or Professionals
• supervise construction activities
• guarantee the quality or results of any service

All Workers and Professionals available through the Platform operate as independent service providers.

Any service agreement for Professional Services exists directly between the User and the Professional performing the service.

4. ELIGIBILITY

To use the Platform:

• You must be at least 18 years old
• You must have the legal capacity to enter into binding agreements
• You must provide accurate information when creating an account or making bookings

OnBase reserves the right to restrict access to users who provide false information.

5. ACCOUNT CREATION

To access certain features of the Platform, Users may be required to create an account.

Users may need to provide:

• name
• phone number
• location details
• other relevant information

You agree that:

• the information provided is accurate and complete
• you will update your information if it changes
• you will maintain the confidentiality of your account credentials

Users are responsible for all activities conducted through their accounts.

6. BOOKINGS

Users may request Professional Services through the Platform by selecting:

• service type
• preferred date or schedule
• service location

Booking Confirmation

A booking is considered confirmed only when:

• the request has been successfully processed
• the booking appears in the user dashboard
• any required payment steps are completed

Substitution

If a Professional becomes unavailable after confirmation, OnBase may attempt to arrange a replacement Professional.

7. PRICING AND PAYMENTS

Users agree to pay the charges displayed on the Platform when making a booking.

Payments may include:

• Worker or Professional service charges
• platform service fees
• applicable taxes

OnBase may collect payments on behalf of Professionals or facilitate payment transfers.

Supported payment methods may include:

• UPI
• digital payment gateways
• other supported online payment methods

OnBase may use third-party payment processors and is not responsible for errors caused by such providers.

8. CANCELLATIONS

Users may cancel bookings according to the cancellation policy displayed on the Platform.

Cancellation charges may apply depending on:

• the timing of the cancellation
• worker availability
• operational impact

If a Professional fails to appear for a confirmed booking, OnBase may attempt to arrange a replacement or provide a refund where applicable.

9. USER CONTENT

Users may post reviews, ratings, or feedback regarding services provided by Professionals.

By submitting such content, you grant OnBase a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and publish such content for operating and improving the Platform.

Users must not post content that is:

• false or misleading
• defamatory
• abusive or discriminatory
• unlawfull

OnBase reserves the right to remove such content.

10. USER CONDUCT

Users must treat Workers and Professionals with respect and dignity.

Users must not:

• discriminate based on religion, caste, gender, ethnicity, or background
• harass or abuse Professionals
• request illegal or dangerous tasks
• misuse the Platform for unlawful purposes

Users must also ensure that the service location provides a safe and respectful working environment.

11. ANTI-CIRCUMVENTION POLICY

Users shall not attempt to directly hire Workers or Professionals outside the Platform after discovering them through OnBase.

Such actions undermine the trust and safety of the Platform and may result in:

• account suspension
• permanent removal from the Platform.

12. INTELLECTUAL PROPERTY

All content on the Platform including logos, designs, text, graphics, and software is owned by or licensed to OnBase.

Users may not reproduce, distribute, or modify any content without prior permission.

13. CONSTRUCTION SITE SAFETY & RISK ACKNOWLEDGEMENT

Construction activities involve inherent risks including injuries, property damage, and equipment hazards.

By using the Platform OnBase, Users acknowledge and agree that:

Responsibility for Worksite Safety

The User (including any contractor, builder, homeowner, or site manager) is solely responsible for maintaining a safe and lawful work environment.

This includes responsibility for:

• site supervision
• safety equipment
• compliance with construction regulations
• safe handling of materials and machinery

No Site Control by OnBase

OnBase does not supervise construction work or control job sites.

OnBase provides only a digital platform for connecting Users with Professionals.

Independent Professional Status

Workers and Professionals operate independently and are responsible for the services they perform.

Limitation of Liability

To the maximum extent permitted by law, OnBase shall not be liable for:

• site accidents
• injuries during construction work
• property damage
• safety violations at construction sites.

14. DISCLAIMERS

The Platform and Services are provided on an “as-is” and “as-available” basis.

OnBase makes no warranties regarding:

• availability of Workers
• service quality
• completion of work
• uninterrupted access to the Platform.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law, OnBase shall not be liable for:

• damages resulting from services provided by Professionals
• project delays
• construction defects
• disputes between Users and Professionals

Total liability of OnBase shall not exceed the platform service fee charged for the relevant booking.

16. INDEMNIFICATION

Users agree to indemnify and hold harmless OnBase, its owner, employees, and affiliates from any claims, damages, or liabilities arising from:

• misuse of the Platform
• violation of these Terms
• disputes with Workers or Professionals.

17. TERMINATION

OnBase may suspend or terminate access to the Platform if:

• these Terms are violated
• fraudulent activity is detected
• misuse of the Platform occurs.

Users may stop using the Platform at any time.

18. FORCE MAJEURE

OnBase shall not be liable for delays or failure to perform obligations due to events beyond its reasonable control including:

• natural disasters
• government restrictions
• network failures
• strikes
• civil disturbances.

19. GOVERNING LAW

These Terms shall be governed by the laws of India including the Information Technology Act, 2000.

20. JURISDICTION

Any disputes arising from these Terms shall fall under the jurisdiction of the courts located in Ahmedabad.

21. MODIFICATIONS

OnBase reserves the right to update these Terms from time to time.

Continued use of the Platform after updates constitutes acceptance of the revised Terms.
